Fraud

The Litigation department has acted for both Claimants and Defendants in fraud claims and each claim is usually very different.

Acting for the Claimant can involve investigatory work, often with forensic accountants or private investigators, before launching a surprise attack on the Defendant. Sometimes, however, the urgency precludes lengthy investigation and proceedings must be launched without delay, with the tracing of assets being an urgent priority.

Acting for a Defendant will often mean responding to an injunction - possibly a freezing order preventing the use of a bank account or a search and seizure order when the Defendant's office or home is subjected to a search authorised by the Court. Responding requires concentrated work in circumstances which are often difficult - especially if the client's ability to use its own funds have been restricted by the Court.

The ability to make available skilled individuals to provide the necessary support is essential. Every individual of the Litigation department has a wealth of experience to represent the interests of clients in the very different circumstances which a fraud claim can generate.
